TERMS AND CONDITIONS

Overview - This site is ran by Sword Gai Arts, any terms such as "we", "our" or "us" refers to Sword Gai Arts.

Disclaimer: We will not be responsible in the event props are used to injure, harm or cause detriment to individuals or property. As products are made for aesthetic value and not to be used in actual combat or any actions that may be deemed unreasonable or unnecessary.  

Payment: A 50% down-payment is required before initiating the start of the product. The remainder will be made upon completion of the product. We accept payment via cash or GTT Mobile Money (MMG+).

Uplifting: (a) Finished props will be available for uplifting two (2) weeks after contacting the customer of its availability. If the customer does not uplift within the aforementioned two (2) weeks, then he/she would have waived their rights to the product and Sword Gai Arts may dispose of the prop.

(b) In the event the customer is not able to uplift prop within the given two (2) weeks and requires an extension. Sword Gai Arts must be informed before or in the first week of uplifting. If not done, then part (a) of this policy will hold

(c) All down-payments are non-refundable. And thus in the event of part (a), when props are forfeited there will be no refund of any initial payments made.

Corrections: In the event all designs information was not provided, we will provide one change given the product has not entered into the final stages. Any additional revisions if requested by the client will be discussed, along with a charge of an additional fee. 

Deadlines: We will make every effort to fulfil all agreed-upon deadlines. For custom orders, there is a seventy two (72) hour grace period for submission. We will discuss the revised timeline with the client and adjust the schedule as necessary if the client requests a change that will affect the timeline.

Cancellation: We will bill the client for the work completed up to the point of cancellation if the client cancels the project after it has begun. The client will receive a full refund for the work period in the event the project was cancelled by us.

Advertising: The right is reserve to use any and all ideas, designs or work done by us. 

Termination of Service: This agreement may be terminated by either party upon written notice with or without reason. We will be compensated by the client for all services provided up until the date of termination.

Refunds: In the event a client claims a refund, they have burden of proof to prove they have been harm or a detriment was caused. After proving this only then will the client be refunded.

Warranties Disclaimer: Whether expressed or implied, our service makes no warranties under any agreement. The client agrees to bear the burden of all risks associated with the product.

Intellectual Property: We agree to transfer any rights, titles, interests or copyrighted materials and information to the client upon agreement. The clients agrees to not use, copy or pretend to represent any aspects of the service or business (including original designs, logo, slogans or any others owned by the company). Additionally we reserve the right to include and use any work done under the service agreement in their professional portfolio.

Indemnity:  The client shall indemnify and hold us harmless to the fullest extent in respect of any and all actions, suits, proceedings, claims, demands, judgement, costs, expenses (including advancement of reasonable attorney’s fees), losses, and damages resulting from utilisation of our products.
